Terms of Service

1. Accepting These Terms
By creating an account or using Arteliora, you agree to these terms. If you do not agree, you may not use the service. You must be at least 13 years old to use Arteliora. If you are entering into these terms on behalf of an entity, you represent that you have authority to bind that entity.
2. Your Account
You are responsible for your account credentials and all activity under your account. Choose a strong cipher and keep it private. Notify us immediately if you suspect unauthorized access. We may suspend or close accounts that appear to be compromised, fraudulent, or in violation of these terms.
3. Your Content
You retain ownership of the artwork you create on Arteliora. By making a work public in the gallery, you grant Arteliora a non-exclusive, royalty-free, worldwide license to host, display, and reproduce that work for the purpose of operating the platform. You are responsible for ensuring your prompts and uploaded content do not infringe on the rights of any third party. We may remove content that we believe, in our sole discretion, violates these terms or applicable law.
4. Acceptable Use
Use Arteliora to create and share art. You agree not to use Arteliora to generate, upload, or distribute any content that is NSFW, adult, pornographic, or sexually explicit, including but not limited to depictions of nudity, sexual acts, sexualized depictions of real or fictional persons, deepfakes, face-swap imagery, or any content that sexualizes or exploits minors. You also agree not to generate harmful, illegal, hateful, harassing, or abusive content, or content that infringes the rights of others. Do not attempt to reverse-engineer, scrape, disrupt, or overload the service, or use automated tools to access the platform beyond what is necessary for normal use. We reserve the right to suspend or terminate accounts and remove content that violate these terms. See our Acceptable Use Policy for further detail.
5. Payment Terms & Merchant of Record
Payments for credit packs and Patron subscriptions are processed by our Merchant of Record, Creem, which handles billing, taxes (including VAT where applicable), and payment processing. Creem appears as the merchant on your card or payment statement. By purchasing credits or a subscription, you authorize Creem to charge your selected payment method for the full amount, including applicable taxes and any fees disclosed at checkout. Prices are displayed in USD; conversions to other currencies are handled by your bank or payment provider and may differ from the displayed amount. If your payment is declined or reversed, we may suspend access to paid features until the issue is resolved.
6. Credits & Tiers
Arteliora offers Apprentice (free) and Patron (subscription) tiers, plus credit packs available for one-time purchase. Patron subscribers receive a monthly allotment of fuel that resets at the end of each billing cycle; unused fuel does not roll over. Credits (welcome grant and purchased packs) never expire. Fuel is drawn first for each co-creation; credits cover any shortfall. Each generation consumes credits and/or fuel at the moment of rendering, reflecting upstream image-generation costs that we incur in real time. Tier pricing and privileges are subject to change with notice.
7. Refund & Cancellation Policy
All purchases are non-refundable, including Pay-As-You-Go credit packs and Patron subscriptions. Because each generation delivers digital content and triggers upstream rendering costs at the moment of creation, you acknowledge and expressly consent that the supply of digital content has begun with your first generation, and you thereby waive any statutory right of withdrawal to the extent permitted by applicable law (including under EU Directive 2011/83/EU). Unused credit balances are not eligible for a cash refund. Patron subscriptions may be cancelled at any time from your curator settings; cancellation stops future renewals and takes effect at the end of the current billing period — we do not offer pro-rated refunds for partial periods. If a generation fails on our side, the credits consumed for that attempt are automatically returned to your balance. If you believe you have been charged in error, contact support before initiating a chargeback; chargebacks initiated through your bank without first contacting us may result in account suspension.
8. Intellectual Property
The Arteliora platform, its design, name, and underlying technology are our intellectual property. The master personas and critique engine are creative simulations inspired by art history and are not affiliated with any estate or foundation. Arteliora and related marks are trademarks of the platform operator. You may not copy, modify, distribute, or create derivative works of the platform itself without our written permission.
9. Limitation of Liability
Arteliora is provided as-is. We make no guarantees about uptime, output quality, or the artistic merit of generated works. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, credits, or goodwill, arising from your use of (or inability to use) the service. Our aggregate liability for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Termination
You may close your account at any time from your curator settings. We may suspend or terminate your account, or revoke access to paid features, if you violate these terms, abuse the service, or if required by law. Upon termination, your right to use the service ends immediately; remaining fuel balances are forfeited, while purchased credits remain available for a reasonable wind-down period or as otherwise required by law. Sections that by their nature should survive termination — including intellectual property, limitation of liability, and dispute resolution — remain in effect.
11. Dispute Resolution & Governing Law
These terms and any dispute arising out of or relating to them are governed by the laws of the jurisdiction in which the platform operator is established, without regard to conflict-of-law principles. Before initiating formal proceedings, you agree to first contact us in good faith at legal@arteliora.com to seek an informal resolution. Any claim or dispute that cannot be resolved informally shall be finally resolved through binding arbitration or in the courts of the platform operator's home jurisdiction, as applicable. Nothing in this section limits any statutory consumer rights you may have under the mandatory laws of your country of residence.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect, where required by law. Continued use after changes take effect constitutes acceptance. The updated terms will be posted here with a revised date.

14. AI & Public Domain Notice
Arteliora utilizes AI to generate artworks inspired by the styles of historical artists whose works are in the public domain. All reference images of historical artworks displayed on this site are sourced from public domain archives (e.g., Wikimedia Commons, CC0). Arteliora is not affiliated with, endorsed by, or sponsored by any artist's estate or museum.
